SECTION 1 – OVERVIEW

Welcome to Chotto Matcha.

These Terms of Service ("Terms") govern your access to and use of the Chotto Matcha website, products, and services (collectively, the "Services"). Throughout these Terms, the words "Chotto Matcha," "we," "us," and "our" refer to Chotto Matcha, a brand operated by MISAKU Inc.

Our online store is powered by Shopify Inc., which provides the e-commerce platform that enables us to offer our products and services to customers worldwide.

By accessing our website, browsing our products, or placing an order through our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you must not access or use our Services.

These Terms apply to all visitors, customers, users, and others who access or use our Services.

We reserve the right to update, modify, or replace these Terms at any time. Any changes will become effective upon publication on this website unless otherwise required by applicable law. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

 

SECTION 2 – ACCESS AND ACCOUNT

To access certain features of our Services, including placing orders or creating an account, you may be asked to provide personal information such as your name, email address, billing address, shipping address, payment information, and phone number.

You agree that all information you provide is accurate, current, and complete, and that you will promptly update your information if any changes occur.

If you create an account with Chotto Matcha, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access to or use of your account.

You must not use another person's account without permission or transfer, sell, or assign your account to any third party.

We reserve the right to suspend or terminate your account, refuse service, or cancel orders if we reasonably believe that you have provided false information, violated these Terms, engaged in fraudulent activity, or used our Services in a manner that may harm Chotto Matcha, our customers, or our business operations.

By using our Services, you confirm that you are legally capable of entering into a binding agreement under the laws applicable in your country or region of residence. If you are under the age of majority, you may only use our Services with the involvement and consent of your parent or legal guardian.

 

SECTION 3 – ORDERS

By placing an order through our Services, you are making an offer to purchase the selected products subject to these Terms.

An order is considered accepted only after we have confirmed your order by email and successfully processed your payment. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to cases involving product availability, pricing errors, suspected fraudulent activity, or violations of these Terms.

Please review your order carefully before completing your purchase. Once an order has been confirmed, we may not be able to cancel or modify it, particularly if the order has already entered processing or shipment.

If we need to cancel or modify your order for any reason, we will make reasonable efforts to notify you using the contact information provided at checkout. If payment has already been collected for an order that cannot be fulfilled, we will issue a refund using the original payment method.

Our products are intended for personal use only. Unless otherwise agreed in writing, products purchased from Chotto Matcha may not be purchased for resale or commercial distribution.

Orders may be subject to availability. In the event that a product becomes unavailable after your order has been placed, we will notify you promptly and provide a suitable replacement, partial shipment, or refund, where applicable.

SECTION 4 – PRICES AND BILLING

All prices displayed on our Services are shown in the currency indicated at checkout. Unless otherwise stated, prices include applicable Japanese consumption tax for orders shipped within Japan.

For international orders, customers are responsible for any customs duties, import taxes, VAT, or other fees imposed by the destination country. These charges are not included in the purchase price or shipping fee unless expressly stated.

We reserve the right to change product prices, shipping fees, promotions, or discounts at any time without prior notice. Any price changes will not affect orders that have already been accepted.

You agree to provide accurate, complete, and current billing and payment information for all purchases. Failure to provide valid payment information may result in the cancellation of your order.

Payments are securely processed through Shopify Payments and/or our authorized third-party payment providers. Chotto Matcha does not store your full credit card information.

If we discover an obvious pricing error, product description error, or technical issue affecting your order, we reserve the right to cancel the order and issue a full refund. We will notify you as soon as reasonably possible should this occur.

If your payment is declined or cannot be successfully processed, your order will not be confirmed until payment has been successfully completed.

SECTION 5 – SHIPPING AND DELIVERY

We aim to process and ship all orders as promptly as possible. Estimated processing and delivery times are provided for reference only and are not guaranteed.

Delivery times may vary depending on the shipping destination, customs procedures, weather conditions, carrier delays, public holidays, or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate shipping information at the time of purchase. Chotto Matcha is not responsible for delays, additional shipping costs, or failed deliveries resulting from incorrect or incomplete addresses provided by the customer.

For international orders, customers are responsible for complying with the import regulations of their destination country. Chotto Matcha is not responsible for customs delays, import restrictions, refused deliveries, or additional customs duties, taxes, or fees imposed by local authorities.

Risk of loss and title for products pass to the customer upon delivery to the shipping carrier, unless otherwise required by applicable law.

If your order arrives damaged or if any items are missing, please contact us within seven (7) days of delivery at hello@chottomatcha.net, including your order number and photographs of the package and products where applicable. We will review each case individually and provide an appropriate resolution where possible.

Because our products are food items, we are unable to accept returns or exchanges due to customer preference after shipment, except where required by applicable law or where products are damaged, defective, or incorrectly delivered.
